Article 1 Object
The present terms and conditions of sale apply, without restriction to all sales made by SimExpress3D company, registered at the RCS of Versailles with the number 821 514 130 00011, and head office located at 54 rue de la bonne aventure, 78000 Versailles – FRANCE, to all professionals and non professionals buyers (here – after the “Buyer”), wishing to acquire products offered for sale by SimExpress3D on the website: http: //www.simexpress.fr (here – after the “Site”).
SimExpress3D is here after named « SIM EXPRESS » for the present terms and conditions of sale.
The general conditions of sale are accessible on this website and prevail, if any, on any other version or any other contradictory document.
Unless proved otherwise, the data recorded by SIM EXPRESS constitutes proof of all transactions.
The validation of the order by the Buyer constitutes acceptance of these Terms and Conditions.
Article 2 SIM EXPRESS products
The characteristics of the SIM EXPRESS products offered for sale are displayed on the site. Each product will be downloaded after payment in a single copy, on a single computer, solely for personal use. The buyer may not:
- use or transmit SIM EXPRESS products to another site or network.
(ii) modify, decompile, disassemble SIM EXPRESS products or create a product derived from SIM EXPRESS products. (iii) distribute, sell or rent SIM EXPRESS products.
Article 3 Validity of offers for sale
The products are offered for sale indefinitely.
SIM EXPRESS reserves the right to remove any product offered for sale on the Site at any time and reserves the right to remove or alter any element constituting the said product. In this case, SIM EXPRESS can not be held responsible or defaulting.
Article 4 Products prices
Prices are in euros excluding VAT.
SIM EXPRESS reserves the right to change prices at any time.
Article 5 Buyings
The data recorded by SIM EXPRESS constitutes proof of the nature, content and date of the order. This is archived by SIM EXPRESS under the conditions and the legal deadlines; the Buyer may access this filing by contacting SIM EXPRESS.
Article 6 Payment terms
The price is payable in full on the day of placing the order by the Buyer with a PayPal account.
Article 7 Product return policy
Due to our products being a download, we can not offer refunds as there is nothing tangible to return. If you do encounter problems though, we will try our best to sort them out.
Article 8 Use of the Site
You may only use this Site and any materials found in this Site (including, but not limited to, any images, logos, designs, insignia, marks, pictures, sounds, text, messages, tools, software, technology, products, files, information, data, demos, promotional materials, audiovisual and multimedia works and any other items or expressions) (collectively, “Materials”) in accordance with the terms and conditions of this Agreement, and you agree to comply with said terms and conditions at all times. Without limiting the foregoing, you may not copy, republish, upload, download, post, transmit or distribute any Materials except as specifically provided by SIM EXPRESS.
Article 9 Intellectual property
The Site content is the property of SIM EXPRESS and is protected by French and international laws on intellectual property. Total or partial reproduction of this content is strictly prohibited and may constitute copyright infringement.
Article 10 Applicable law
This contract is governed by and subject to French law.
Article 11 Acceptance of Buyer
Placing an order on the Site implies full acceptance of the present conditions of Sale, as expressly recognized by the Purchaser, who waives in particular to invoke any contradictory document, which would be unenforceable against SIM EXPRESS.
